ELECTRICITY SUPPLY TO CSIRO MANAGED SITES IN QLD AND SA
The Commonwealth Scientific and Industrial Research Organisation (CSIRO) through this Request for Tender (RFT) is seeking responses from suitably qualified and experienced service providers for the provision of grid-fed electricity supply for CSIRO-managed sites in Queensland and South Australia.
5.1 Conditions for Participation
5.1.1 Subject to clause 5.7, Unintentional Errors of Form, CSIRO will exclude a Tenderer from further consideration and evaluation if CSIRO considers in its absolute discretion that the conditions for participation set out in this clause have not been met by the Tenderer. Notwithstanding anything else contained in this RFT, only requirements listed in this clause will be deemed conditions for participation.
a.the Tenderer exists as a legal entity at the RFT Closing Time and Date
b.at the time of lodgement of their Tender, Tenderers must not have been:
i.precluded from tendering for Australian Government funded work or
ii.subject to a judicial decision against them relating to employee entitlements (not including decisions under appeal, and have not paid the claim
c.where the Tenderer is a Relevant Employer, the Tenderer is compliant with its obligations under the Workplace Gender Equality Act 2012 (Cth) (the WGE Act). Further information may be found at http://www.wgea.gov.au/
d.Tenderers (including new businesses and foreign Tenderers) are required to provide evidence of their compliance as specified in Item 1.1.1 of Attachment A – SOR TRS (Statement of Requirements and Tender Response Schedules) – Stage 1 and successful Tenderer/s must provide a Valid and Satisfactory Statement of Tax Record/s prior to the award of a Contract.
e.the Tenderer must comply with all Mandatory Requirements identified in the Attachment A SOR TRS (Statement of Requirements and Tender Response Schedules) – Stage 1.
5.2 Minimum Content and Format Requirements
5.2.1 Subject to clause 5.7, Unintentional Errors of Form, CSIRO will exclude a Tenderer from further consideration if CSIRO considers in its absolute discretion that the Tenderer’s response does not meet the minimum content and format requirements listed in this clause. Notwithstanding anything else contained in this RFT, only requirements listed in this clause will be deemed minimum content and format requirements for the purposes of this RFT.
a. The Tender must be lodged electronically via AusTender, the Australian Government Tendering System, in accordance with, clause 3.9, AusTender Terms and Conditions
b.The Tenderer must complete and submit in their Response the:
i. Tenderer’s Deed Poll, substantially in for form at Schedule 6, as set out in Attachment A SOR TRS – (Statement of Requirements and Tender Response Schedules) Stage 1.
c.Where the Tenderer is a Relevant Employer, the Tenderer must provide evidence as specified in Schedule 2 item 1.1.2 of Attachment A SOR TRS – (Statement of Requirements and Tender Response Schedules) Stage 1. Further information can be found at clause 5.9.
d.Tenderers (including new businesses and foreign Tenderers) are required to provide evidence of their Statement of Tax Record compliance as specified in of Attachment A SOR TRS (Statement of Requirements and Tender Response Schedules) – Stage 1.
e.Noting the requirement at clause 5.2.1 b, Tenderers should substantially complete all remaining schedules of Attachment A SOR TRS – (Statement of Requirements and Tender Response Schedules) Stage 1.
f.The Tender, including all attachments and supporting material, must be written in English.
g.Alternative solutions will only be considered where the Tenderer also provides in its Tender, a response that conforms to the specified requirements of this RFT.
1.2 Mandatory Requirements
1.2.1 The Respondent must (directly or through commercial Contracts executed prior to the RFT Closing Date) have the required licences for sale of electricity in all of the Regions it offers to supply.
1.2.2 Respondents must demonstrate and provide evidence of its financial stability and creditworthiness through;
a. submission of a current credit rating report from a recognised credit rating agency or independent third-party audit report. Such reports should be no older than twelve months from the date of submission of the proposal; and
b. providing recent financial statements audited by a certified public accountant (CPA) or an equivalent regulatory body. Financial statements should cover the past three financial years and include balance sheets, income statements, and cash flow statements.
1.2.3 Respondents must confirm (or provide evidence) that CSIRO’s estimated annual load for each given region (as per Table 1 and 2 Section 1.7 below) does not exceed 5% of the respondents’ total customer load for the respective region.
